Terms of service

These Terms of Service ("Terms") govern your use of the website goldenmoon.company and all its language versions (the "Site") and every purchase you make on it. Please read them before placing an order. By using the Site or placing an order you agree to these Terms, our Privacy Policy, our Shipping Policy and our Refund and Return Policy, which form part of these Terms.

1. Who we are

The Site is operated by Golden Moon Global Trading Limited ("Golden Moon", "we", "us", "our"), a limited company incorporated in Hong Kong under the Companies Ordinance (Chapter 622 of the Laws of Hong Kong).

2. What we do

Golden Moon is an online retailer. We sell consumer electronics, accessories, tools and pet supplies made by manufacturers and supplied by vendors in mainland China. When you place an order, we buy the item from our supplier. Our logistics partner, 4PX, receives it at its warehouse in Shenzhen, China, packs it and ships it to you. We deliver only to the countries listed in our Shipping Policy.

Unless a product page says otherwise, we are not an authorised dealer of the brands whose products we resell. A manufacturer's warranty may be limited to the country where the product was originally sold, and the manufacturer may not honour it in your country. Your statutory rights against us are not affected (see section 10).

3. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to place an order. You may shop as a guest or create a customer account. You are responsible for keeping your login details confidential and for all activity under your account. Tell us at once if you believe your account has been used without your permission.

4. Rules of use

When you use the Site you agree not to:

• break any law, or buy products for resale in breach of any law or of a third party's rights;
• give false information, use another person's identity or payment details, or place fraudulent orders;
• interfere with the Site or its security: scraping, automated ordering, overloading, probing or circumventing technical measures;
• upload or send unlawful, abusive, defamatory or infringing content, or send spam through any contact form;
• misuse promotions, reviews or any other feature of the Site.

We may refuse or cancel an order, and suspend or close an account, if we reasonably believe these Terms have been broken or the Site is being misused. If we cancel an order you have paid for, we refund the full amount you paid.

5. Products and product information

We take care to describe and show products accurately. Colours on screen may differ from the actual product, and minor variations in packaging may occur because packaging can change between production batches. Product descriptions are translated from the supplier's information. If anything matters to you, such as a plug type, language of the interface or compatibility, contact us before ordering.

6. Prices and currency

Prices are shown in US dollars (USD). Product prices do not include shipping. Shipping is calculated at checkout for your address and the delivery service you choose.

Prices do not include import duties, import VAT or GST, or customs clearance fees charged by your country. These charges are your responsibility; see section 9.

If your card is issued in another currency, your bank converts the amount at its own exchange rate and may charge a fee. We are not responsible for such charges.

If a product is listed at an obviously incorrect price because of a technical or typographical error, we may cancel the order and refund you in full, even after you have received the order confirmation email.

7. Orders and contract

Your order is an offer to buy. After you place it, you receive an automatic email confirming that we have received your order; this email is not yet our acceptance. We accept your order, and the contract between you and us is concluded, when we send you an email confirming that your order has shipped.

We may decline an order if a product is unavailable from our supplier, if we cannot deliver to your address, or if we suspect fraud. In that case we refund any amount charged.

You can cancel an order free of charge before it is shipped by emailing support@goldenmoon.company with your order number. Rights to cancel or return after shipment are set out in our Refund and Return Policy.

8. Payment

Payment is taken at checkout through our payment provider. We accept the methods shown at checkout, which currently include Visa, Mastercard, American Express, UnionPay, Apple Pay, Google Pay and Shop Pay. We do not see or store your full card number; card data is processed by our payment provider in accordance with PCI DSS.

9. Delivery, customs, risk and ownership

Delivery times and conditions are set out in our Shipping Policy. Delivery estimates are given in good faith but are not guaranteed; delays can be caused by carriers, customs or events outside our control.

Your parcel is shipped from China to the address you give us. You are the importer of record. Your country's customs authority may charge import duties, taxes and clearance fees. The carrier may collect them before delivery. If you refuse to pay these charges or do not collect the parcel, it may be returned or destroyed. In that case we refund the price of the goods, less any return or destruction charges we incur; the original shipping charge is not refunded, except where the law of your country gives you a better right.

Risk of loss and damage passes to you when the goods are delivered to you or to a person you name. Ownership passes to you on delivery, provided we have received full payment.

10. Warranties and your statutory rights

We guarantee that the goods correspond to their description on the Site at the time of your order. If an item arrives damaged, defective or different from what you ordered, follow the steps in our Refund and Return Policy.

Apart from the above and the rights you have by law, the products are supplied "as is", and to the fullest extent permitted by law we disclaim all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Nothing in these Terms limits or excludes any right you have as a consumer under the mandatory law of the country where you live, including statutory guarantees for faulty goods and statutory rights to withdraw from distance contracts.

11. Limitation of liability

To the fullest extent permitted by law:

• our total liability arising from or in connection with an order is limited to the total amount you paid for that order;
• we are not liable for indirect or consequential loss, loss of profit, loss of data or loss of business opportunity;
• we are not liable for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, epidemics, strikes, government action and failures of telecommunications or the internet.

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be limited or excluded by law.

12. Intellectual property

The Site, its design, text, graphics and logos belong to Golden Moon or its licensors. You may use the Site for personal, non-commercial shopping only. Product names and trademarks belong to their respective owners and are used only to identify the products.

13. Privacy

We process personal data as described in our Privacy Policy.

14. Third-party services

The Site is hosted on the Shopify platform. Payments are processed by our payment provider and parcels are carried by 4PX and its local delivery partners. Their own terms may apply to the parts of the service they provide.

15. Governing law and disputes

These Terms and any contract between you and us are governed by the laws of the Hong Kong Special Administrative Region. Before going to court, please contact us at support@goldenmoon.company: most issues can be solved quickly. The courts of Hong Kong have non-exclusive jurisdiction.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country.

16. Changes to these Terms

We may update these Terms from time to time. The version published on the Site when you place an order applies to that order. The date at the top shows when the Terms were last updated.

17. Other provisions

If any provision of these Terms is found invalid, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies linked above, are the entire agreement between you and us about your purchase. These Terms are written in English. Translations are provided for convenience; if a translation differs from the English text, the English text prevails, except where the law of your country requires otherwise.
